Under Article 5 of the EU AI Act, AI systems that deploy subliminal, manipulative, or deceptive techniques to distort human behavior and cause significant harm are strictly prohibited. Additionally, systems that exploit specific human vulnerabilities related to age, disability, or socio-economic situation to distort behavior and cause harm are completely banned across the EU market.

Article 5 strictly bans social scoring systems evaluated by public or private entities when scoring leads to detrimental treatment of individuals in unrelated contexts. Furthermore, building or expanding facial recognition databases through untargeted scraping of facial images from the internet or CCTV footage is illegal for all software products.
