Terms of Use

These Terms of Use are a legal agreement between you and Auracle Learning Ltd. Please read them before you use Auracle. If you bought a subscription through the App Store, these terms are also the end user licence agreement (EULA) for the Auracle app.

1. About us and these terms

Auracle is operated by Auracle Learning Ltd., a company registered in England and Wales under company number 17088536, with its registered office at Hollyhocks, The Street, Charmouth, Dorset, DT6 6QE, United Kingdom. In these terms, "we", "us" and "our" mean Auracle Learning Ltd., and "you" means the person using Auracle.

These terms apply to the Auracle website at auracle.live, the Auracle mobile apps, and any related content and services we provide. We call all of this "Auracle" or "the service".

By creating an account, downloading the app, or otherwise using Auracle, you agree to these terms. If you do not agree to them, please do not use Auracle. Our Privacy Policy explains how we handle your personal data and forms part of your agreement with us.

2. Who can use Auracle

You must be at least 13 years old to create an Auracle account. If you are under 18, you may only use Auracle with the permission of a parent or guardian, and a parent or guardian must agree to these terms on your behalf and be responsible for any payments.

You confirm that the information you give us when you register is true and complete, and that you will keep it up to date.

3. Your account

You can sign in to Auracle with an email address, or with Sign in with Apple or Google. You are responsible for keeping your login details secure and for everything that happens under your account.

Your account is for you alone. Please do not share it, sell it, or let other people study on it. If you think someone else has accessed your account, tell us at support@auracle.live straight away.

4. What Auracle does

Auracle is a voice-first study app. It reads study material out loud, listens to your spoken answers through your device microphone, and schedules what you review using a spaced repetition algorithm. You can study content from our library or create your own study decks.

Auracle needs microphone access and an internet connection to work. Speech recognition, speech synthesis, and AI content generation are performed using third party providers, as described in our Privacy Policy.

Auracle is a study tool. We cannot promise any particular learning outcome, exam result, or level of fluency. How much you learn depends on how you use it.

5. Using Auracle safely

Auracle is designed to be used hands-free, which means people often study while walking, exercising, doing chores, or travelling. You are responsible for deciding when it is safe to study, and you must always follow the law where you are.

Driving and operating machinery. Never hold, touch, or look at your device while driving, cycling, or operating machinery. Set up your session before you set off, or pull over safely first. Laws on device and headphone use while driving vary by country, and it is your responsibility to comply with them. If a study session distracts you at any point, stop studying and give your full attention to the road.

Staying aware of your surroundings. If you study while walking, running, or in a public place, keep the volume low enough to hear traffic and people around you, and stay aware of where you are going.

Your hearing. Auracle plays audio continuously during a session. Keep the volume at a comfortable level to protect your hearing, especially when using headphones.

Recording other people. Your microphone stays active during study sessions. Please do not use Auracle where it would capture other people's conversations without their knowledge or consent.

6. Free plan and paid plans

Auracle has a free plan and several paid subscription plans. The free plan does not expire and does not require payment. It is not a trial, so it will never convert into a paid subscription on its own. You will only ever be charged if you choose to buy a subscription.

Each plan includes a study time allowance and an allowance of AI content generations. Study time is measured while you are in an active study session. One AI generation is used each time you run a generation, whether or not you keep the result. Allowances on paid plans reset at the start of each billing period. The free plan's AI allowance is a one-off lifetime allowance rather than a monthly one.

Every paid plan is a monthly subscription that renews automatically until you cancel it. Prices depend on your country and currency, and the exact price and billing period are always shown to you before you confirm a purchase. You can see current plans on our pricing page.

We may change plan allowances from time to time as the service develops. If we reduce the allowances on a paid plan you already hold, we will tell you first, and you can cancel before the change takes effect.

7. Subscriptions bought through the App Store

If you buy a subscription inside the Auracle iOS app, Apple processes the payment and the following applies:

  • The subscription is an auto-renewable monthly subscription to Auracle, giving you the study time and AI generation allowance for your chosen plan during each monthly period.
  • Payment is charged to your Apple Account when you confirm the purchase, at the price shown at the point of purchase.
  • The subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
  • Your Apple Account is charged for the renewal within 24 hours before the end of the current period, at the price then shown for your plan.
  • You can manage your subscription and turn off auto-renew at any time in your Apple Account settings after purchase. Deleting the app does not cancel your subscription.
  • If you cancel, you keep access to your paid plan until the end of the period you have already paid for.
  • Refunds for App Store purchases are handled by Apple under the Apple Media Services Terms and Conditions, not by us.

8. Subscriptions bought on our website

If you buy a subscription on auracle.live, payment is processed by Stripe. Your chosen payment method is charged when you subscribe and again at the start of each monthly period, until you cancel.

You can cancel or change your subscription at any time through the billing portal, which you can reach from your account page. Cancelling stops future payments. You keep access to your paid plan until the end of the period you have already paid for.

We do not store your card details. Payments are handled by our payment processor.

9. Price changes

We may change our prices. If the price of a plan you subscribe to goes up, we will give you reasonable notice before the change applies, and the new price will only take effect from your next renewal. You can cancel before then if you do not want to continue.

10. Refunds

Except where a refund is required by law, payments are non-refundable, including for partly used billing periods and for periods where you did not use your allowance.

Nothing here affects your statutory rights as a consumer. If you are a consumer in the UK or the EU, you may have a legal right to cancel a purchase within 14 days. Because Auracle gives you immediate access to digital content, you agree that we start supplying the service straight away, and you accept that this may mean you lose that cancellation right once supply has begun.

For purchases made through the App Store, please request refunds directly from Apple.

11. Your content

You keep ownership of the study decks, cards, notes, images, and other material you create or upload. We call this "your content".

You give us a licence to host, store, copy, adapt, and process your content, and to generate audio from it, so that we can run the service for you. This licence is limited to operating, supporting, and improving Auracle, and it ends when you delete the content or your account, except for copies we need to keep in backups or to comply with the law.

Publishing a deck publicly. You can choose to publish a deck so that it appears in our public directory. If you do, you give us a non-exclusive, worldwide, royalty-free licence to display, distribute, and make that deck available for other Auracle users to study, and to show it in listings and search results. You can unpublish a deck at any time, which stops us making it available to new users going forward.

You are responsible for what you upload. You confirm that you own your content or have permission to use it, and that uploading it and turning it into study cards does not infringe anyone else's rights. This matters when you photograph textbook pages, paste web pages, or use material from a course. Please only upload material you are allowed to use, and only publish a deck publicly if you have the right to share the underlying material.

We may remove or unpublish content that breaks these terms, infringes someone's rights, or creates a legal risk for us. If you believe content on Auracle infringes your copyright, contact us at support@auracle.live.

12. AI generated content

Auracle can generate study material automatically from a prompt, a document, a photo, or a web page. AI generated content can be wrong, incomplete, or out of date, even when it sounds confident.

Please check anything important against a reliable source before you rely on it, especially for exams, qualifications, or professional work. Auracle does not provide medical, legal, financial, or other professional advice, and generated content should never be treated as such.

You are responsible for the prompts and source material you provide, and for how you use the results.

13. Voice and audio

Study sessions need microphone access. Your speech is streamed to our speech recognition provider so your spoken answers can be transcribed and checked. Our Privacy Policy explains what we collect, how it is used, and who processes it.

You can withdraw microphone access at any time in your device settings, but Auracle's hands-free study will not work without it.

14. Acceptable use

When using Auracle, you agree not to:

  • break the law, or use Auracle for any unlawful or fraudulent purpose
  • upload or publish content that infringes intellectual property rights, invades privacy, or is defamatory, hateful, harassing, sexually explicit, or otherwise harmful
  • upload other people's personal or confidential information without a lawful basis for doing so
  • try to get around plan limits, usage allowances, paywalls, or access controls, including by creating multiple accounts
  • share, resell, or commercially redistribute Auracle content or access, unless we have agreed in writing
  • scrape, crawl, or bulk download content, or access the service through automated means except where we allow it
  • reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent the law permits
  • interfere with the service, probe it for vulnerabilities, or place an unreasonable load on our systems or those of our providers
  • impersonate anyone, or misrepresent your connection with a person or organisation

15. Our intellectual property

Auracle, including the software, the website, the apps, our name and logo, and the study decks, courses, and audio we produce, is owned by Auracle Learning Ltd. or our licensors and is protected by intellectual property laws.

We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use Auracle and to study our content for your own personal, non-commercial learning, for as long as you comply with these terms. We do not transfer any ownership to you, and all rights we have not expressly granted are reserved.

16. Third party services

Auracle relies on third parties, including Apple and Google for app distribution and sign-in, payment processors, speech recognition and speech synthesis providers, and AI model providers. Some parts of the service link to third party websites and content that we do not control.

When you use Auracle, you must also comply with any relevant third party terms that apply to you, including your mobile network or data plan terms and the App Store terms.

17. Availability and changes to the service

We work to keep Auracle available and running well, but we cannot promise it will be uninterrupted or error free. We may need to suspend parts of the service for maintenance, updates, or reasons outside our control.

We may add, change, or remove features as the product develops. If we make a change that significantly reduces what a paid plan gives you, we will tell you and you can cancel.

18. Suspension, cancellation, and deleting your account

You can stop using Auracle at any time. You can cancel a subscription as described above, and you can delete your account from your account page or by contacting us at support@auracle.live.

Deleting your account removes your decks, cards, and study progress. This cannot be undone, and cancelling or deleting your account does not automatically entitle you to a refund.

We may suspend or end your access if you seriously or repeatedly break these terms, if we are required to by law, or if your use puts other users, our providers, or us at risk. Where it is reasonable to do so, we will warn you first and give you a chance to put things right. If we end your access without good reason, we will refund any period you have paid for but cannot use.

19. Disclaimers

Auracle is provided on an "as is" and "as available" basis. To the extent permitted by law, we exclude all implied warranties and conditions, including that the service will meet your requirements, be free of errors, or produce any particular learning result.

Nothing in these terms excludes or limits your statutory rights as a consumer. If you are a consumer in the UK, you have legal rights in relation to digital content that is faulty or not as described, and those rights are not affected by these terms.

20. Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that, we are not liable for loss or damage that was not foreseeable, for loss of profit, revenue, business, or goodwill, or for loss arising from your use of Auracle in a situation where it was unsafe or unlawful to do so.

Subject to the paragraphs above, our total liability to you for all claims connected with Auracle in any 12 month period is limited to the greater of the amount you paid us for the service in that period, or 50 pounds sterling.

We supply Auracle for personal, non-commercial use. If you use it for any commercial purpose, we have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.

21. Additional terms for the App Store

This section applies if you downloaded the Auracle app from the Apple App Store. If it conflicts with anything else in these terms, this section applies for App Store downloads.

  • Acknowledgement. These terms are between you and Auracle Learning Ltd. only, and not with Apple. We, not Apple, are solely responsible for the Auracle app and its content. These terms do not provide usage rules for the app that conflict with the Apple Media Services Terms and Conditions.
  • Scope of licence. The licence we grant you for the app is a non-transferable licence to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
  • Maintenance and support. We are solely responsible for providing any maintenance and support for the app. Apple has no obligation to provide any maintenance or support services for the app.
  • Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our sole responsibility.
  • Product claims. We, not Apple, are responsible for addressing any claims from you or a third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual property claims. If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
  • Legal compliance. You represent and warrant that you are not located in a country subject to a US Government embargo or designated by the US Government as a terrorist supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.
  • Third party terms. You must comply with any applicable third party terms when using the app, such as your wireless data service agreement.
  • Third party beneficiary. You and we acknowledge that Apple and Apple's subsidiaries are third party beneficiaries of these terms, and that on your acceptance of these terms Apple will have the right, and will be deemed to have accepted the right, to enforce these terms against you as a third party beneficiary.
  • Questions and complaints. Any questions, complaints, or claims about the app should be sent to Auracle Learning Ltd., Hollyhocks, The Street, Charmouth, Dorset, DT6 6QE, United Kingdom, or by email to support@auracle.live.

22. Changes to these terms

We may update these terms as Auracle changes or as the law requires. If a change is significant, we will give you reasonable notice, for example by email or in the app, before it takes effect. Continuing to use Auracle after a change takes effect means you accept the updated terms. If you do not accept them, you can cancel your subscription and stop using the service.

The date at the top of this page shows when these terms were last updated.

23. Governing law and disputes

These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

If you are a consumer resident in another country, this does not deprive you of the protection of the mandatory consumer laws of that country, and you may also bring proceedings in the courts of the country where you live.

If something goes wrong, please contact us first at support@auracle.live. We would much rather sort a problem out directly.

24. General

If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, that does not mean we have given it up.

We may transfer our rights and obligations under these terms to another organisation, for example if our business is sold. If we do, we will tell you, and your rights under these terms will not be affected. You may not transfer your rights or obligations without our written consent.

These terms and our Privacy Policy are the whole agreement between you and us about your use of Auracle.
